Oracle Secures Judgment Against ServiceKey and Its CEO, Angela Vines

REDWOOD SHORES, CA — (Marketwired) — 06/17/13 — Oracle (NASDAQ: ORCL)

On June 11, 2013, United States District Judge Saundra Brown Armstrong entered judgment in Oracle-s favor against defendants ServiceKey, LLC and its CEO, Angela Vines, on Oracle-s claims against ServiceKey and Vines for copyright infringement, violation of the Computer Fraud and Abuse and Lanham Acts, fraud, intentional interference with prospective economic relations and unfair competition.

The judgment reflects ServiceKey-s and Vines- admission to liability on Oracle-s claims. ServiceKey and Vines, among other things, admitted that they illegally and without authorization downloaded, copied and distributed Oracle-s copyrighted Solaris Operating System, including Solaris software updates and patches, falsely advertised their ability to provide the copyrighted Oracle Solaris patches to customers, and illegally trafficked in passwords to Oracle-s customer support website.

As part of the judgment against Service Key and Vines, the Court issued an injunction that prohibits the defendants from engaging in a wide range of conduct that had led to Oracle-s lawsuit. The Court-s injunction mandates that ServiceKey and Vines may not “give, receive, sell or otherwise provide to anyone any Oracle/Sun software and/or support materials, including any updates, bug fixes, patches, media kits or other proprietary software support materials, and including any patches, bug fixes or updates to the Solaris Operating System.”

The injunction also prohibits ServiceKey and Vines from falsely advertising that they can provide Oracle-branded support, including “Oracle Premier Support for Systems.”

The judgment requires ServiceKey and Vines to inform every current and future customer, in a written statement ordered by the Court, that they may not provide this copyrighted Oracle software and support material to any customer.

The Court-s injunction further prohibits Service Key and Vines from ever again accessing any password-protected Oracle website. ServiceKey and Vines must also search all computers and computer storage locations for any Oracle software or support files and to “destroy and thereafter ceases to use any and all such materials.”

The Court-s judgment ends the lawsuit brought by Oracle against ServiceKey and Vines on February 12, 2012 in the United States District Court for the Northern District of California.

“The judgment entered by the Court conclusively establishes the liability by ServiceKey and its CEO Angela Vines that Oracle would have proved at trial and, through the Court-s injunction, protects Oracle-s intellectual property, including its Solaris Operating System, from ServiceKey and Vines in the future,” said Geoff Howard, attorney for Oracle. “This Court order also allows Oracle to audit ServiceKey-s and Vines- activities in the future to assure compliance with the judgment and injunction.”
